Common use of DURATION OF AGREEMENT AND TERMINATION Clause in Contracts

DURATION OF AGREEMENT AND TERMINATION. This Agreement shall be in effect from October 1, 2008 through the period ending September 30, 2010; provided that this Agreement may be terminated by either party, giving at least 90 days' prior written notice to the other party of its intention to terminate this Agreement; further provided that if the City or District shall fail or refuse to perform or comply with any of the obligations or provisions herein agreed, the affected party shall have the right to notify the other party in writing of such default; and if the party so notified shall remain in default for 30 days thereafter, the affected party may elect to cancel this Agreement immediately thereafter.
