Common use of Duration of Restrictions Clause in Contracts

Duration of Restrictions. The foregoing Covenants and Restrictions are to run with the land and shall be binding on all parties and all persons claiming under them for a period of ten (10) years, and shall be automatically extended for successive periods of ten (10) years unless prior to expiration of any such ten (10) year period, and instruments signed by the owners of record of a majority of lots in the Project has been recorded changing or modifying said covenants in whole or in part “except that restriction II (F) pertaining to plumbing, restriction II (F) (5) pertaining to planned public water and public sewer and restriction IV pertaining to flood plains shall run in perpetuity and shall not be amended”.
