Excavation. If an excavation shall be made upon land adjacent to the Leased Premises, or shall be authorized to be made, Tenant shall afford to the person causing or authorized to cause such excavation, license to enter upon the Leased Premises for the purpose of doing such work as said person shall deem necessary to preserve the wall or the building of which the Leased Premises form a part from injury or damage and to support the same by proper foundation, without any claim for damages or indemnity from Landlord, or diminution or abatement of Rent.
Excavation. Contractor shall comply with the provisions of Labor Code Section 6705, if applicable, by submitting to Public Agency a detailed plan showing the design of shoring, bracing, sloping, or other provisions to be made for worker protection from the hazard of caving ground during trench excavation.
Excavation. All excavation related work must be conducted in accordance with OSHA 1926 Subpart P - Excavations, and CCI requirements.
Excavation. 1.07.01 Before excavating, the Contractor must determine whether any underground pipe lines, electric wires, or cables, including fiber optic cable systems are present and located within the Project work area. The Contractor must determine whether excavation on Railway’s Property could cause damage to buried cables resulting in delay to Railway traffic and disruption of service to users. Delays and disruptions to service may cause business interruptions involving loss of revenue and profits. Before commencing excavation, the Contractor must contact BNSF’s Field Engineering Representative (Xxxx Xxxxxxxx, 909-386-4079). All underground and overhead wires will be considered HIGH VOLTAGE and dangerous until verified with the company having ownership of the line. It is the Contractor's responsibility to notify any other companies that have underground utilities in the area and arrange for the location of all underground utilities before excavating.
Excavation. The Political Body shall not excavate from existing slopes nor construct new slopes which are excessive and may create hazards of slides or falling rock, or impair or endanger the clearance between existing or new slopes and the tracks of the Railroad. The Political Body shall not do or cause to be done any work which will or may disturb the stability of any area or adversely affect the Railroad's tracks or facilities. The Political Body, at its own expense, shall install and maintain adequate shoring and cribbing for all excavation and/or trenching performed by the Political Body in connection with construction, maintenance or other work. The shoring and cribbing shall be constructed and maintained with materials and in a manner approved by the Railroad's Assistant Vice President Engineering - Design to withstand all stresses likely to be encountered, including any stresses resulting from vibrations caused by the Railroad's operations in the vicinity.

1.07.02 The Contractor must cease all work and notify the Railway immediately before continuing excavation in the area if obstructions are encountered which do not appear on drawings. If the obstruction is a utility and the owner of the utility can be identified, then the Contractor must also notify the owner immediately. If there is any doubt about the location of underground cables or lines of any kind, no work must be performed until the exact location has been determined. There will be no exceptions to these instructions.
1.07.03 All excavations must be conducted in compliance with applicable OSHA regulations and, regardless of depth, must be shored where there is any danger to tracks, structures or personnel.
1.07.04 Any excavations, holes or trenches on the Railway's Property must be covered, guarded and/or protected when not being worked on. When leaving work site areas at night and over weekends, the areas must be secured and left in a condition that will ensure that Railway employees and other personnel who may be working or passing through the area are protected from all hazards. All excavations must be back filled as soon as possible.
Excavation. No excavation shall be made on, and no sand, gravel or soil shall be removed from, any Site, except in connection with the construction of Improvements, and upon completion thereof, exposed openings shall be backfilled, and disturbed ground shall be graded, leveled and paved or landscaped.
Excavation. Section 20.01. In the event that an excavation should be made for building or other purposes upon land adjacent to the Building, or should be authorized to be made, Tenant shall, if necessary, afford to the person or persons causing or authorized to cause such excavation, license to enter upon the Demised Premises for the purpose of doing such work as shall reasonably be necessary to protect or preserve the wall or walls of the Building, or the Building, from injury or damage and to support them by proper foundations, pinning and/or underpinning.
Excavation. All excavation shall be carried out to the lines and levels shown on the drawings or to such lines and levels as the Engineer may direct. The Contractor shall trim all permanent excavation to the lines and levels shown on the drawings. Excavation shall generally be executed in such a manner as to ensure that the side slopes, as shown on the drawings, are not in any way endangered by undercutting. As far as practicable, all suitable materials from the excavations shall be used in embankment and backfill for structures. The Contractor shall dispose of unsuitable or excess soil of the excavated materials in a place that is acceptable to the local community and so that they do not interfere with proper functioning of the works. All necessary precautions shall be taken to preserve the material below and beyond the lines of all excavation in the soundest possible condition. Any damage to the work due to the Contractor’s operations, including shuttering to the material beyond the required excavation lines, shall be repaired at the expense of and by the Contractor. Any and all excess excavation or over excavation performed by the Contractor for any purpose or reason, except as may be directed in writing by the Engineer, and whether or not due to fault of the Contractor, shall be at the expense of the Contractor. Excavation taken out to a greater depth than is necessary shall be filled to the required level with concrete of appropriate class or other material approved by the Engineer. All such excess excavation and over excavation shall be filled at the expense of and by the Contractor. The bottom and side slopes of excavation against which concrete is to be placed shall be finished accurately to the dimension shown on the drawings or as prescribed by the Engineer and the surface so prepared shall be moistened with water and tamped or rolled with suitable tools or equipment for the purpose of securing a firm foundation. If at any point the natural foundation material is disturbed during the excavation process or otherwise, it shall be compacted in place, or it shall be removed and replaced with suitable earth materials or concrete at the expense of the Contractor.
Excavation. Prior to any excavation conducted on a County road or road allowance, the Contractor shall:
