Dust Mitigation. Fresh water, as defined by the Commission, may be applied to roads and land surfaces for purpose of dust mitigation. Absolutely no other liquid or substance generated from the production of the Operator’s facility, including but not limited to Exploration and Production Waste (as defined by the Commission) shall be permitted to be applied to roads and land surfaces.

Dust Mitigation. Operator shall use only fresh water (as defined by the Commission) on roads or land surfaces for dust mitigation.
Dust Mitigation. During construction all dust and debris shall be removed from sidewalks, parkways and streets on a daily basis. If this condition is not met, the City of San Xxxxxxx will maintain the area and the cost will be charged to the property owner.
Dust Mitigation. All activities generating dust (e.g. land clearing, soil moving, drilling and blasting, crushing and screening, vehicle movements, burning) shall abide by the requirements and performance criteria of the Dust Suppression Program as set out in Chapter Nine of the Rehabilitation, Sediment and Dust Control Program prepared for the Site. Neither respirable particulate or dust fallout may exceed the limits nominated in the environmental management reports. Necessary dust mitigation measures may include: • watering dusty roads, stockpiles and bare areas • using water mists, screening or collecting dust at crushing plants and other fixed sites • adhering to speed limits on roads • covering trucks while in transit Waste oil must not be used as a dust suppressant.
Dust Mitigation. The Flats Developer shall comply with all City requirements pertaining to mitigation of fugitive dust as a result of the Work. The Flats Developer shall, at a minimum, be required to sprinkle any areas of active construction from time to time as required to avoid excessive transmission of dust particles from the Flats Property to the VillaRosso Property during the Term and will engage in daily cleanup. The Flats Developer shall, at the completion of the Work and at one other time during construction as may be requested by the VillaRosso Association, clean the western and southern outside of the VillaRosso Condominium to remove dust, dirt, and debris created by the construction. In completing all such Work, the Flats Developer will mitigate any cleanliness issues and cooperate with the VillaRosso Association and any contractor that the VillaRosso Association may hire to observe and approve such Work.

  • Set Off; Mitigation The Company’s obligation to pay Employee the amounts provided and to make the arrangements provided hereunder shall be subject to set-off, counterclaim, or recoupment of amounts owed by Employee to the Company or its affiliates; provided, however, that to the extent any amount so subject to set-off, counterclaim, or recoupment is payable in installments hereunder, such set-off, counterclaim, or recoupment shall not modify the applicable payment date of any installment, and to the extent an obligation cannot be satisfied by reduction of a single installment payment, any portion not satisfied shall remain an outstanding obligation of Employee and shall be applied to the next installment only at such time the installment is otherwise payable pursuant to the specified payment schedule. Employee shall not be required to mitigate the amount of any payment provided pursuant to this Agreement by seeking other employment or otherwise, and except as provided in Section 8(d)(iv) hereof, the amount of any payment provided for pursuant to this Agreement shall not be reduced by any compensation earned as a result of Employee’s other employment or otherwise.

  • Mitigation Executive shall not be required to mitigate the amount of any payment or benefit provided for in this Agreement by seeking other employment or otherwise and there shall be no offset against amounts due Executive under this Agreement on account of any remuneration attributable to any subsequent employment that Executive may obtain.

  • Mitigation; Offset The Executive is under no obligation to seek other Employment or to otherwise mitigate the obligations of the Company under this Agreement, and the Company may not offset against amounts or benefits due Executive under this Agreement or otherwise on account of any claim (other than any preexisting debts then due in accordance with their terms) the Company or its affiliates may have against him or any remuneration or other benefit earned or received by Executive after such termination.

  • Aggravating and Mitigating Factors The penalties in this matter were determined in consideration of all relevant circumstances, including statutory factors as described in CARB’s Enforcement Policy. CARB considered whether the violator came into compliance quickly and cooperated with the investigation; the extent of harm to public health, safety and welfare; nature and persistence of the violation, including the magnitude of the excess emissions; compliance history; preventative efforts taken; innovative nature and the magnitude of the effort required to comply, and the accuracy, reproducibility, and repeatability of the available test methods; efforts to attain, or provide for, compliance prior to violation; action taken to mitigate the violation; financial burden to the violator; and voluntary disclosure. The penalties are set at levels sufficient to deter violations, to remove any economic benefit or unfair advantage from noncompliance, to obtain swift compliance, and the potential costs, risks, and uncertainty associated with litigation. Penalties in future cases might be smaller or larger depending on the unique circumstances of the case.

  • No Mitigation Executive shall not be required to mitigate the amount of any payment provided for in this Agreement by seeking other employment or otherwise and no such payment shall be offset or reduced by the amount of any compensation or benefits provided to Executive in any subsequent employment.

  • No Set-off or Mitigation Company’s obligation to make the payments provided for in this Agreement and otherwise to perform its obligations hereunder shall not be affected by any set-off, counterclaim, recoupment, defense or other claim, right or action which Company may have against Executive or others. In no event shall Executive be obligated to seek other employment or take any other action by way of mitigation of the amounts payable to Executive under any of the provisions of this Agreement and, except as otherwise provided herein, such amounts shall not be reduced whether or not Executive obtains other employment.

  • Full Settlement; Mitigation The Company’s obligation to make the payments provided for in this Agreement and otherwise to perform its obligations hereunder shall not be affected by any set-off, counterclaim, recoupment, defense or other claim, right or action which the Company may have against the Executive or others, provided that nothing herein shall preclude the Company from separately pursuing recovery from the Executive based on any such claim. In no event shall the Executive be obligated to seek other employment or take any other action by way of mitigation of the amounts (including amounts for damages for breach) payable to the Executive under any of the provisions of this Agreement, and such amounts shall not be reduced whether or not the Executive obtains other employment.
