Dust Mitigation. Operator shall use only fresh water (as defined by the Commission) on roads or land surfaces for dust mitigation.
Dust Mitigation. The Flats Developer shall comply with all City requirements pertaining to mitigation of fugitive dust as a result of the Work. The Flats Developer shall, at a minimum, be required to sprinkle any areas of active construction from time to time as required to avoid excessive transmission of dust particles from the Flats Property to the VillaRosso Property during the Term and will engage in daily cleanup. The Flats Developer shall, at the completion of the Work and at one other time during construction as may be requested by the VillaRosso Association, clean the western and southern outside of the VillaRosso Condominium to remove dust, dirt, and debris created by the construction. In completing all such Work, the Flats Developer will mitigate any cleanliness issues and cooperate with the VillaRosso Association and any contractor that the VillaRosso Association may hire to observe and approve such Work.
Dust Mitigation. Fresh water, as defined by the Commission, may be applied to roads and land surfaces for purpose of dust mitigation. Absolutely no other liquid or substance generated from the production of the Operator’s facility, including but not limited to Exploration and Production Waste (as defined by the Commission) shall be permitted to be applied to roads and land surfaces.

  • Set Off; Mitigation The Company’s obligation to pay Employee the amounts provided and to make the arrangements provided hereunder shall be subject to set-off, counterclaim, or recoupment of amounts owed by Employee to the Company or its affiliates; provided, however, that to the extent any amount so subject to set-off, counterclaim, or recoupment is payable in installments hereunder, such set-off, counterclaim, or recoupment shall not modify the applicable payment date of any installment, and to the extent an obligation cannot be satisfied by reduction of a single installment payment, any portion not satisfied shall remain an outstanding obligation of Employee and shall be applied to the next installment only at such time the installment is otherwise payable pursuant to the specified payment schedule. Employee shall not be required to mitigate the amount of any payment provided pursuant to this Agreement by seeking other employment or otherwise, and except as provided in Section 8(d)(iv) hereof, the amount of any payment provided for pursuant to this Agreement shall not be reduced by any compensation earned as a result of Employee’s other employment or otherwise.

  • Mitigation Executive shall not be required to mitigate damages or the amount of any payment provided under this Agreement by seeking other employment or otherwise, nor shall the amount of any payment provided for under this Agreement be reduced by any compensation earned by Executive as a result of employment by another employer or by any retirement benefits received by Executive after the date of the Covered Termination, or otherwise.

  • Mitigation; Offset The Executive is under no obligation to seek other Employment or to otherwise mitigate the obligations of the Company under this Agreement, and the Company may not offset against amounts or benefits due Executive under this Agreement or otherwise on account of any claim (other than any preexisting debts then due in accordance with their terms) the Company or its affiliates may have against him or any remuneration or other benefit earned or received by Executive after such termination.
