Common use of Duties of PNC Clause in Contracts

Duties of PNC. PNC shall (i) act reasonably in accordance with the Documentation to facilitate making available Provided Information via the Web Applications on an “as is” basis and shall permit the Trust to make all elections with respect to the Services which the Documentation provides for a Web Application content provider to make, and (ii) provide the Trust at PNC’s standard rates and charges, to the extent requested by the Trust, with Inquiry access to Provided Information via the PNC Applications.

Duties of PNC. PNC makes no representations or warranties with respect to the operation of the Web Applications.

Duties of PNC. PNC shall (i) act reasonably in accordance with the Documentation to facilitate making available Provided Information via participation by the Fund in the Services and the Web Applications Portal on an “as is” basis as made available by AdvisorCentral and shall permit the Trust Fund to make all elections with respect to the Services which the Documentation provides for a Web Application content provider Fund to make, and (ii) provide the Trust Fund at PNC’s its standard rates and charges, to the extent requested by the TrustFund, with Inquiry inquiry access to Provided Information via Shareholder Data in the Web Portal. PNC Applicationsmakes no representations or warranties with respect to the operation of the Web Portal.
