Duty Not to Use or Disclose After Termination. These confidentiality obligations shall continue as long as the Confidential Information and/or records remain confidential and shall survive both the termination of this Agreement and the termination of Executive’s employment with the Employer. If this Agreement is being enforced by a court applying the law of a jurisdiction where a specific time frame is required for a confidentiality provision to be enforceable, then the period during which these confidentiality obligations shall continue is the period of the Executive’s employment with the Employer and two (2) years from his or her last date of employment with the Employer.
