Common use of Early Termination Charge Clause in Contracts

Early Termination Charge. (a) You may cancel the Service at any time in accordance with Clause 15.1(a). However, if your Application or Service Contract records that you have agreed to receive the Service from us for a Fixed Term and you cancel the Service before the expiry of the Fixed Term, you will be liable to pay an Early Termination Charge. (b) If we cancel or terminate a Service because of your breach of this Agreement and your Application or Service Contract records that you have agreed to receive the Service from us for a Fixed Term and the cancellation or termination is before the expiry of the Fixed Term, you will be liable to pay an Early Termination Charge.
