Common use of Earned but Unpaid Bonus Clause in Contracts

Earned but Unpaid Bonus. In addition to any other amounts owed to Executive under this paragraph 4.b, if the Company terminates the Executive’s employment for any reason other than Cause or if Executive terminates employment after December 31 of any year, Executive shall be entitled to receive any Bonus earned by Executive for the preceding year as calculated in accordance with paragraph 3(b) but not yet paid as of the termination date.

In addition to any other amounts owed to Executive under this paragraph 4.b, if the Company terminates the Executive’s employment for any reason other than Cause or if Executive terminates employment on or after December 31 of any year31, 2008, Executive shall be entitled to receive any Bonus earned by Executive for the preceding year 2008 as calculated in accordance with paragraph 3(b) 3.b but not yet paid as of the termination date.
