Common use of Earning of Performance Units Clause in Contracts

Earning of Performance Units. After the applicable Performance Period has ended, the holder of Performance Units shall be entitled to receive a payout of the number of Performance Units earned by the Participant over the Performance Period, to be determined as a function of the extent to which the corresponding performance objectives have been achieved. After the grant of a Performance Unit, the Committee, in its sole discretion, may reduce or waive any performance objectives for such Performance Unit.

Earning of Performance Units. After Subject to the terms of the Plan, after the applicable Performance Period has ended, the holder of Performance Units shall be entitled to receive a payout of on the value and number of Performance Units earned by the Participant over the Performance Period, to be determined as a function of the extent to which the corresponding performance objectives goals have been achieved. After the grant of a Performance Unit, the Committeeas set forth in further detail on Schedule 1, in its sole discretion, may reduce or waive any performance objectives for such Performance Unitattached hereto.

After the grant of a Performance Unit, the Committee, in its sole discretion, may reduce or waive any performance objectives for such Performance Unit.
