Common use of Effect of Agreement on Land Use Regulations Clause in Contracts

Effect of Agreement on Land Use Regulations. Except as otherwise provided under the terms of this Agreement including the Reservations of Authority, the rules, regulations and official policies governing permitted uses of the Property, the density and intensity of use of the Property, the maximum height and size of proposed buildings and structures, and the design, improvement and construction standards and specifications applicable to development of the Property shall be the Existing Land Use Regulations. In connection with any Subsequent Development Approval, COUNTY shall exercise its discretion in accordance with the Development Plan, and as provided by this Agreement including, but not limited to, the Reservations of Authority. COUNTY shall accept for processing, review and action all applications for Subsequent Development Approvals, and such applications shall be processed in the normal manner for processing such matters.

In connection with any Subsequent subsequently adopted Development ApprovalApprovals and except as specifically provided otherwise herein, COUNTY shall CITY may exercise its discretion in accordance with the Development PlanLand Use Regulations then in effect, and as provided by this Agreement Agreement, including, but not limited to, the Reservations Reservation of AuthorityRights. COUNTY CITY shall accept for processing, review and action all applications for Subsequent Development Approvalssubsequent development approvals, and such applications shall be processed in the normal manner for processing such mattersexpeditiously.
