The required certificates must be filed with the Owner and copied maintained by the Contractor as of the beginning date of this contract and each subcontract, supplier contract, or consultant contract, and upon final payment to the subcontractor or consultant. State officials, including officials of the Georgia Department of Audits and Accounts, officials of the Owner, retain the right to inspect and audit the Project Site and employment records of the Contractor, subcontractors and consultants without notice during normal working hours until Final Completion, and as otherwise specified by law and by Rules and Regulations of the Georgia Department of Audits and Accounts.

The CMR and all Trade Contractors, Subcontractors and consultants must comply with all federal and state work authorization and immigration laws, and must, as a material condition of this Contract, certify compliance with O.C.G.A. §13-10-91 in strict accordance with paragraph 22 of the Contract. The required Contractor’s affidavit (Exhibit L) must be filed with the Owner at contract execution and shall become a part of this Contract. Required subcontractor affidavits must be obtained and maintained by the CMR as of the beginning date of this contract and the beginning date of each subcontract or consultant contract. A copy of each such verification shall be provided to the Board at the time the subcontractor or consultant is retained. Compliance with Federal and State Work Authorization and Immigration Laws. Governmental Entity certifies its compliance with Illegal Immigration Reform and Enforcement Act of 2011 and specifically those provisions codified at O.C.G.A. §13-10- 90, et seq. Governmental Entity warrants that it has registered with and uses the federal work authorization program commonly known as “E-Verify.” Governmental Entity further agrees that it will contract for the physical performance of services in satisfaction of this contract only with subcontractors who present an affidavit as required by O.C.G.A. §13- 10-91. Governmental Entity warrants that it will include a similar provision in all contracts entered into for the physical performance of services in satisfaction of this contract.

Contractor shall provide the Owner with notice of the identity of any and all subcontractors or consultants within five days of entering into the subcontract.
