Common use of Effect of Agreement on Land Use Regulations Clause in Contracts

Effect of Agreement on Land Use Regulations. Except as otherwise provided under the terms of this Agreement, the rules, regulations and official policies governing permitted uses of the Subject Property, the density and intensity of use of the Subject Property, the maximum height and size of proposed buildings, and the design, improvement, and construction standards and specifications applicable to Development of the Subject Property, shall be only the Existing Regulations and those contained in the Development Plan.

Effect of Agreement on Land Use Regulations. Except as otherwise provided under the terms of this Agreement, the rules, regulations and official policies governing permitted uses of the Subject Property, the density and intensity of use of the Subject Property, the rate or timing of development, the maximum height and size of proposed buildings, and the design, improvement, improvement and construction standards and specifications applicable to Development of the Subject PropertyDevelopment, shall be only the Existing Regulations and those contained in the Development PlanApprovals and those Land Use Regulations not inconsistent with the Development Approvals that were in full force and effect as of the Effective Date.

Effect of Agreement on Land Use Regulations. Except as otherwise provided under the terms of this Agreement, : the rules, regulations and official policies governing permitted uses of the Subject Property, Site; the density and intensity of and use of the Subject Property, Site; the maximum height height, bulk, and size of proposed buildings, and structures; the general location of public utilities; the design, improvement, and improvement and construction standards and specifications applicable to Development development of the Subject PropertySite; and other terms and conditions of development applicable to the Project, shall be only the Existing Regulations and those contained are set forth in the Development PlanLand Use Regulations which are in full force and effect as of the Effective Date of this Agreement, subject to the terms of this Agreement.

Except as (a) Unless otherwise provided under herein or by the terms provisions of this Agreementthe Residential Development Control System, the rules, regulations and official policies governing permitted uses of the Subject Propertyreal property, the governing density and intensity of use of the Subject Property, the maximum height and size of proposed buildings, and governing the design, improvement, improvement and construction standards and specifications applicable to Development development of the Subject Propertyreal property are those rules, shall be only regulations and official policies, including without limitation building code requirements, in force at the Existing Regulations and those contained in time of the Development Planexecution of this Agreement.

Effect of Agreement on Land Use Regulations. Except as otherwise provided under the terms of this AgreementAgreement including the Reservations of Power in Section 4(e), the rules, regulations and official policies governing permitted uses of the Subject Property, the density and intensity of use of the Subject Property, the maximum height and size of proposed buildings, and the design, improvement, improvement and construction standards and specifications applicable to Development of the Subject Property, Property shall be only the Existing Current Land Use Regulations and those contained in provided they do not conflict with the Development Plan.Approvals described in Exhibit C.
