Common use of EFFECT OF CONTINUED NON-COMPLIANCE WITH PROVISIONS OF CPC Clause in Contracts

EFFECT OF CONTINUED NON-COMPLIANCE WITH PROVISIONS OF CPC. Failure to correct the non-compliance indicated in section 1 above by 12/31/2019 (date) may result in the following actions: (i) Contract termination with forfeiture of all program contract payments (ii) Recovery of previously paid financial assistance payments (iii) Assessment of liquidated damages (iv) Interest accruing on the amount determined to be owed beginning 30 days after billing date. Any amounts assessed will be due and owing upon CPC termination. The termination of a CPC, including the amount of any costs assessed, is appealable.
