Effect of Failure to Obtain Final Judgment. If the Court fails to enter 25 Judgment in accordance with this Agreement, or if the Judgment is vacated or reversed, then the Action 26 shall proceed, unless the Parties jointly agree to seek reconsideration or a renegotiated settlement.
