Common use of Effect of Force Majeure; Extension of Time Clause in Contracts

Effect of Force Majeure; Extension of Time. After notice of Force Majeure is given, neither Party shall be liable for any failure or delay in complying with its obligations under or pursuant this Agreement to the extent that such failure has been caused, or contributed to, by one or more Events of Force Majeure or its or their effects or by any combination of those events and effects; provided, however, that no relief shall be granted to a Party pursuant to this Section to the extent that such failure or delay would have been experienced by such Party even if such event of Force Majeure had not occurred.
