Effect of Improper Notice. Unless and until the Company receives a validly delivered Fundamental Change Repurchase Notice with respect to this Note, together with this Note, in a form that conforms in all material aspects with the description contained in such Fundamental Change Repurchase Notice, the Holder will not be entitled to receive the Fundamental Change Repurchase Price for this Note.
