Effect of Lump Sum Price Change Order. The Lump Sum Price shall become the Contract Price for full and final completion of the Project in accordance with the Contract Documents. The Design-Builder’s Fee and the Construction Contingency shall be eliminated from the Construction Budget and, to the extent they have been paid, shall be included in the Lump Sum Fee. Unpaid amounts from these GMP budget categories shall be returned to the Owner, provided however, that Design-Builder may retain within the Lump Sum Price the reasonable amounts required for completion of the Program Manager services and for the reasonable Design-Builder’s Fee to be earned through completion of the Project.
