Common use of Effect of Other Agreements Clause in Contracts

Effect of Other Agreements. If any termination or severance payments or benefits are made or provided to Executive by the Company or any or its affiliates pursuant to a written employment or other agreement with the Company or Affiliate, such payments and benefits shall reduce the amount of the comparable payments and benefits payable hereunder if and to the extent necessary to avoid duplication of payments or benefits.

Effect of Other Agreements. If Notwithstanding the provisions hereof, if any termination or severance payments or benefits are made or provided to the Executive by the Company or any or its affiliates pursuant to a written employment or other agreement with between the Company or AffiliateExecutive and the Company, such the payments and benefits required to be provided under this Agreement shall reduce be reduced by the amount of the comparable payments and benefits payable hereunder if and to the extent necessary under such other agreement(s) in order to avoid duplication of payments or benefitsduplication.
