Common use of Effect of Other Indemnities Clause in Contracts

Effect of Other Indemnities. The Lessee's obligations under the indemnities provided for in this Agreement shall be those of a primary obligor whether or not the Person indemnified shall also be indemnified with respect to the same matter under the terms of this Agreement, the Lease, the Indenture, the Trust Agreement, or any other document or instrument, and the Person seeking indemnification from the Lessee pursuant to any provision of this Agreement may proceed directly against the Lessee without first seeking to enforce any other right of indemnification.

Effect of Other Indemnities. The Lessee's obligations under the indemnities provided for in this Agreement Article 7 shall be those of a primary obligor whether or not the Person indemnified shall also be indemnified with respect to the same matter under the terms of this Agreement, the Lease, the Indenture, the Trust Agreement, or any other document or instrument, and the Person seeking indemnification from the Lessee pursuant to any provision of this Agreement may proceed directly against the Lessee without first seeking to enforce any other right of indemnification.

The Lessee's obligations under the indemnities provided for in this Agreement and the Long-Term Agreements shall be those of a primary obligor whether or not the Person indemnified shall also be indemnified with respect to the same matter under the terms of this Agreement, the Lease, the Indenture, the Trust Agreement, any Lease or any Long-Term Agreement or any other document or instrument, and the Person seeking indemnification from the Lessee pursuant to any provision provisions of this Agreement may proceed directly against the Lessee without first seeking to enforce any other right of indemnification.
