Effect of unilateral termination notice. Where the Train Operator has served a unilateral termination notice on Network Rail: (a) the service of the unilateral termination notice shall not affect the parties’ continuing obligations under this contract up to the date of termination specified in the unilateral termination notice; and (b) the contract shall terminate under Clause 3.5 on the later of: (i) the date and time specified in the unilateral termination notice; and (ii) the date upon which a copy of the unilateral termination notice is sent to XXX.
