Common use of Effect of Violation Clause in Contracts

Effect of Violation. Employee and Employer acknowledge and agree that additional consideration has been given for Employee entering into this paragraph 8, such additional consideration including, without limitation, the termination payments pursuant to paragraph 7 hereof and a portion of the common stock issued pursuant to Section 4.3 hereof. Violation by Employee of this paragraph 8 shall relieve Employer of any obligation it may have to make such termination payments, but shall not relieve Employee of his obligations, as required hereunder, not to compete.

Violation by Employee of this paragraph 8 shall relieve Employer of any obligation it may have to make such bonus and termination payments, but shall not relieve Employee of his obligations, as required hereunder, not to compete.
