Common use of Effect on Benefit Plans Clause in Contracts

Effect on Benefit Plans. The existence of this Agreement shall not prohibit or restrict Executive's entitlement to participate in the executive compensation, employee benefit and other plans or programs in which executives of the Company or the Operating Company are eligible to participate. Nothing herein shall restrict the Company's or the Operating Company's right to amend any plan, practice, policy or program in a manner generally applicable to similarly situated active executives, in which event Executive shall be entitled to participate on the same basis (including payment of applicable contributions) as similarly situated active executives of the Company.

Effect on Benefit Plans.
