Common use of Effect on the Benefits of this Contract Clause in Contracts

Effect on the Benefits of this Contract. Section 11.4 applies when the Order of Benefit Rules in Section 11.3 determine that this Contract is Secondary to one or more other Plans. (1) The benefits that would be payable for the Allowable Expenses under this Contract in the absence of this COB provision; and (2) The benefits that would be payable for the Allowable Expenses under the other Plans, in the absence of COB provisions like this Contract's COB provisions, whether or not a claim is made. The benefits of this Contract will be reduced so that they and the benefits payable under the other Plans do not exceed the Allowable Expenses. Each benefit will be proportionally reduced and then charged against any applicable benefit limit of this Contract.
