Effect Upon Seller's Obligations. In the event of the enactment of any new federal, state or other governmental law, or the promulgation of any regulation or order thereunder which may prohibit (or restrict so as effectively to prohibit) mining, or processing or shipping, as may be applicable, of the coal specified in this Agreement, Seller shall be relieved of its obligation upon the effective date of implementation (compliance date) of such law, regulation or order to deliver the total quantity of coal to be delivered under this Agreement to the extent of the amount of tonnage represented by the percentage of production of such mining, processed or shipped coal so affected by such law, regulation or order to the total amount of coal produced and processed to meet the quantity requirements of this Agreement.
