Effective Date and Implementation Date. This Amendment shall be deemed effective upon approval by the Commission; however, the Parties agree to begin implementation of the provisions of this Amendment the later of March 7, 2011 or upon execution.
Effective Date and Implementation Date. A. Effective Date This Agreement shall become binding upon the parties on the date on which the last of the following actions occurs:
1. State legislation taking effect that authorizes the Department to enter into the Agreement on behalf of the State;
2. Signature by the State Treasurer or his or her designee as authorized by the State legislation;
3. Signature by a representative of the Tribe; and
4. Certification by the Tribe’s legal counsel that the signatory acting on behalf of the Tribe has the necessary authority to enter into this Agreement and to bind the Tribe to this Agreement.
B. Implementation Date
Effective Date and Implementation Date. This Settlement Agreement shall be effective on the date of the Commission’s approval of this Settlement Agreement. To eliminate uncertainty and allow time for implementation, the Settling Parties request that the Commission approve this Settlement Agreement no later than March 21, 2008. Assuming such approval, the attached revisions to the PJM Open Access Transmission Tariff (“PJM Tariff”) and the Operating Agreement of PJM Interconnection, L.L.C. (“PJM Operating Agreement”) shall be effective on June 1, 2008.
