Common use of EFFECTIVENESS AND APPLICABLE TERM Clause in Contracts

EFFECTIVENESS AND APPLICABLE TERM. This Agreement shall be effective as to each group of Applicable Assets as of the Effective Time as set forth on Exhibit C and shall terminate with respect to each group of Applicable Assets as set forth on Exhibit C, unless extended by written mutual agreement of the Parties or as set forth in Article 8 (each, the “Applicable Term”). The Party desiring to extend this Agreement with respect to any group of Applicable Assets pursuant to this Article 7 shall provide prior written notice to the other Party of its desire to so extend this Agreement; such written notice shall be provided not more than twenty-four (24) months and not less than the later of twelve (12) months prior to the date of termination of the Applicable Term or ten (10) days after receipt of a written request from the other Party (which request may be delivered no earlier than twelve (12) months prior to the date of termination of the Applicable Term) to provide any such notice or lose such right.
