Effects of Reclassifications – Vacancies. When the classification of the position has been changed as a result of changes in the organizational structure or abrupt changes in the duties and responsibilities of the position, such positions shall be considered vacant under the provisions of this Article. A reclassified position shall be considered a vacancy under the provisions of this Article if the action leading to the change in the classification of the position resulted from: o The assignment of the incumbent to work out of class in a manner so as to by-pass the selection process. o The assignment of the incumbent to a vacancy in a new position which had not been allocated to a class, or; o Other action taken without regard to the appropriate selection process. When the reclassified position is a vacancy, the incumbent Employee does not possess the required licensure, certification or registration, the position shall be filled as provided in this article.
