Common use of Eight (8) Hour Break Clause in Contracts

Eight (8) Hour Break. An employee who is called in to work prior to their next 2 regularly scheduled shift and who works no less than twelve (12) hours without at least eight (8) 3 hours break before the start of their next regularly scheduled shift will, upon request, be relieved from 4 their next regularly scheduled shift. The employee can be directed by the County, for safety reasons, 5 to not work their next regularly scheduled shift. In either of the above instances, the employee will 6 receive overtime pay for all such overtime hours worked, but may receive no pay for the regularly 7 scheduled shift from which the employee was relieved.
