Meal and Rest Periods. Employees shall receive an unpaid thirty (30) minute meal period during each regular workday and two (2) paid rest periods of fifteen (15) minutes each during each eight (8) or ten (10) hour workday. Employees who cannot be relieved of all duties shall be paid at the appropriate rate for their meal period. Meal periods and rest periods shall be administered in accordance with state law. Subject to written mutual agreement meal and/or rest periods may be combined.

Meal and Rest Periods. For assignments where the employee is unable to leave for a thirty (30) minute meal period (i.e., live-in, shift or respite) the meal period shall be paid as time worked. For assignments where the employee is able to leave for a thirty (30) minute meal period (i.e., hourly), the meal period shall be unpaid. Except for emergencies, employees will be completely relieved from duty during the unpaid meal period. Fifteen (15) minute paid rest periods will be provided approximately midway through each four (4) hour segment of each shift. Employees will not be required to work longer than three (3) hours without a rest period, except in emergencies.

Employees engaged in continuous shift operations shall be exempt from this clause, but shall be entitled to a lunch period of thirty (30) minutes on the Employer’s time. In the event of an earlier than normal start, the Employer shall have the right to change the time of the meal period in order to avoid the double penalty. In the event that the Employer changes the time for a scheduled meal period it will inform the employees of the change. 11.03 A fifteen (15) minute rest period will be given twice each shift, midway before lunch, and midway after lunch, provided that each work period is of not more than two and one half (2½) hours. It is agreed that except in cases of personal necessity, employees shall not ask for additional time off during the day. It is mutually agreed that the rest period shall not be abused. a) Employees who use excessive time as determined by the Employer will have the excessive time used on each break deducted from their weekly hours worked. b) Employees who for reasons supported by medical documentation show a specific condition to exist which necessitates greater use of the washroom will not have time deducted for the use of the washroom. The Union agrees to work with the Employer to deal with employees who are abusing personal breaks. 11.04 Notwithstanding this section, it is agreed that should a work period exceed two and one half (2½) hours as a consequence of overtime being called, a third fifteen (15) minute rest period shall be granted except where the Employer provides a second meal break in accordance with Article 11.01. 11.05 In the event of short shifts, employees will be paid for the afternoon rest period if they work up to or through the time normally scheduled for the rest period. Meal and Rest Periods. Nurses shall receive an unpaid meal period of one-half (1/2) hour and a paid rest period of fifteen (15) minutes in each four (4) hour period of work. Nurses required to work during this meal period shall be compensated for such work at the appropriate rate.
