Either TEBA or the Association Clause Samples
The 'Either TEBA or the Association' clause establishes that certain rights, responsibilities, or actions outlined in the agreement may be exercised or initiated by either TEBA or the Association. In practice, this means that both parties are granted equal authority to, for example, submit notices, request meetings, or enforce specific provisions under the contract. This clause ensures procedural fairness and flexibility by allowing either party to act as needed, thereby preventing delays or disputes over which party has the right to take action in a given situation.
Either TEBA or the Association may initiate a grievance by serving a written notice of a difference as follows:
a) In the case of a grievance by the Association, by serving the notice to the Chair of the Board of Directors of TEBA.
b) In the case of a grievance by ▇▇▇▇, by serving the notice to the Coordinator of Teacher Welfare of the Association.
