Election to Terminate This Lease. If Landlord gives notice of election to terminate Xxxxxx’s possession of the Premises, Landlord shall be entitled to recover from Tenant the amounts specified in California Civil Code Sections 1951.2(a)(1), (2) and (4) as it reads upon the Commencement Date, together with interest on such amounts at the maximum legal rate per annum from the dates they were due, computed as of the date of the award, together with the worth at the time of the award of the amount by which the unpaid rent for the balance of the Term exceeds the amount of such rental loss that Tenant proves could be reasonably avoided pursuant to California Civil Code Section 1951.2(a)(3).
