Electronic Document. A copy of this Agreement or signature page hereto signed and transmitted by facsimile machine, as an attachment to an e-mail or by other electronic means (collectively an “Electronic Document”), shall be treated as an original document. The signature of any party thereon, for purposes hereof, is to be considered an original signature, and the Electronic Document transmitted is to be considered to have the same binding effect as an original signature on an original document. No party shall raise the use of an Electronic Document or the fact that a signature was transmitted through the use of a facsimile machine, e-mail or other electronic means as a defense to the enforcement of this Agreement or any amendment or other document executed in compliance with this Agreement.
Electronic Document. A document that is generated, sent, received, or stored by electronic, optical or similar means, including, but not limited to, electronic data interchange, advanced communication methods, electronic mail, telegram, telex or telecopy. Electronic Warehouse Receipt (EWR). A warehouse receipt authorized by AMS to be electronically issued or transmitted under the USWA. EWR Provider. A person or entity authorized by AMS as a disinterested third party that maintains one or more confidential and secure electronic systems independent of any outside influence or bias in action or appearance.
Electronic Document. Any Project-related correspondence, attachments to correspondence, data, documents, drawings, information, or graphics, including but not limited to Shop Drawings and other Submittals, that are in an electronic or digital format.
Electronic Document. It refers to the record made of any text, sound, picture, image, symbol, or other information generated by electronic or other means not directly recognizable by human perceptions, but capable of conveying the intended information for electronic processing.
Electronic Document. Electronic records and signatures may be used in connection with the execution of this Agreement. This Agreement is an electronic record executed by the parties hereto using electronic signatures. This Agreement is just as legally valid and enforceable as if the parties hereto had signed it on paper using a handwritten signature.
Electronic Document. This Agreement (which includes any Order Addenda thereto) may be signed electronically using a means reasonably designed to acknowledge assent. If this Agreement is electronically signed, it: (a) is considered a “writing” or “in writing,” (b) is deemed for all purposes as physically “signed,” (c) is deemed an “original” when printed or copied from electronic files or records established and maintained in the normal course of business, and (d) satisfies any legal formalities requiring that agreements be in writing. Neither Party shall contest the admissibility of copies of this Agreement (or printed version of same) under either the business records exception to the hearsay rule or the best evidence rule or otherwise on the basis that this Agreement was originated, signed or maintained in electronic form. Other than an original hand written signature or an electronic signature of the same formality used to originally execute this Agreement, no other communication between the Parties (such as email, voice mail or fax without a signature) shall be construed as a signature to this Agreement (or any amendments hereto or any waiver hereof).
Electronic Document. 28.1 The Merchant agrees to receive this Agreement in an electronic form and hereby confirms to have read, understood and accepted the terms and conditions of the Agreement upon acceptance Merchant Application Form and/or Letter of Offer issued by MBB. 28.2 The Parties hereby agree that pursuant to the Electronic Commerce Act 2006, executed and scanned copies of the Agreement and/or Merchant Application Form and/or Letter of Offer issued by MBB sent to the Parties electronically shall be deemed as valid and this Agreement shall not be denied its legal effect, validity or enforceability.
