Common use of Electronic Protected Health Information Clause in Contracts

Electronic Protected Health Information. “Electronic Protected Health Information” shall have the meaning set forth in 45 C.F.R. § 160.103. For purposes of this Agreement, “Electronic Protected Health Information” is limited to Electronic Protected Health Information that is: (i) disclosed to or used by BUSINESS ASSOCIATE by virtue of its contract with the STATE and/or its provision of goods and services to or for the STATE; and/or (ii) created, received, maintained, or transmitted by BUSINESS ASSOCIATE on behalf of the STATE.

For purposes of this Agreement, “Electronic Protected Health Information” is limited to Electronic Protected Health Information information of Covered Entity that is: (i) disclosed to Business Associate receives, accesses, maintains or used by BUSINESS ASSOCIATE by virtue of its contract with the STATE and/or its provision of goods and services to or for the STATE; and/or (ii) created, received, maintained, or transmitted by BUSINESS ASSOCIATE transmits in electronic media on behalf of the STATECovered Entity under the terms and conditions of this Agreement.
