Eligible Contract Participant; Eligible Commercial Entity. It qualifies as (i) an “eligible contract participant” as defined at Section 101(12) of the Commodity Futures Modernization Act of 2000 (7 U.S.C.A. Section 1a(12) (West Supp. 2001) and (ii) as to transactions to be entered into on “electronic trading facilities”, an “eligible commercial entity” as defined at Section 101(11) of the Commodity Futures Modernization Act of 2000 (7 U.S.C.A. Section 1a(11) (West Supp. 2001)). The material terms of each Transaction have been individually negotiated and tailored to each party.
