Eligible Take-Out Clause Samples

The 'Eligible Take-Out' clause defines the criteria and conditions under which a loan or financial obligation can be replaced or refinanced by another lender or financial institution. Typically, this clause specifies the types of institutions or financial products that qualify as acceptable replacements, such as major banks or government-backed loans, and may outline procedural requirements for the substitution. Its core function is to ensure that any refinancing or replacement of the original obligation maintains the lender's risk profile and meets agreed standards, thereby protecting the interests of the original lender or investor.
