EMERGENCY RESPONSE AND NOTIFICATION OF RELEASES. 39. In the event of any action or occurrence during performance of the Work which causes or threatens to cause a release of Waste Material from the GASCO Sediments Site that constitutes an emergency situation or may present an immediate threat to public health or welfare or the environment, Respondents shall immediately take all appropriate action. Respondents shall take these actions in accordance with all applicable provisions of this Settlement Agreement, in order to prevent, xxxxx or minimize such release or endangerment caused or threatened by the release. Respondents shall also immediately notify the EPA Project Coordinator or, in the event of his/her unavailability, the Regional Duty Officer, Environmental Cleanup Office, Emergency Response Unit, EPA Region 10, (000) 000-0000, of the incident or conditions. In the event that Respondents fail to take appropriate response action as required by this Paragraph, and EPA takes such action instead, Respondents shall reimburse EPA all costs of the response action not inconsistent with the NCP pursuant to Section XV (Payment of Response Costs). 40. In addition, in the event of any release of a hazardous substance from the GASCO Sediments Site, Respondents shall immediately notify the EPA Project Coordinator and the National Response Center at (000) 000-0000.
