Emergency Termination or Suspension Pending Investigation. If the Superintendent determines that any of the Events of Default set forth in Section 9.1 has occurred and that thereby the health or safety of the Charter School’s students is immediately put at risk, the District shall provide the Charter School written notice of such Event(s) of Default and, upon delivering such notice, may either terminate this Contract immediately or may exercise superintending control of the Charter School pending investigation of the pertinent charge. a) If the District shall elect to exercise superintending control pending investigation of the pertinent charge, the District shall give the School written notice of the investigation, shall commence such investigation immediately, shall permit the School fairly to address the pertinent charge, and shall thereafter complete its investigation as quickly as reasonably practicable. b) Upon completing its investigation, the District shall promptly deliver to the School in writing either a notice of immediate termination on the basis set forth in this Section 9.2, or a notice of an Event of Default and an opportunity to cure pursuant to Section 9.2(2), or a notice rejecting the pertinent charge and reinstating control of the Charter School to the District.
