Common use of Emissions Clause in Contracts

Emissions. Tenant shall not: 8.1.1 Knowingly permit any vehicle on the Premises or in the Commons Areas to emit Hazardous Materials (defined below) which is in violation of any governmental law, rule, regulation or requirement; 8.1.2 Discharge, emit or permit to be discharged or emitted, any liquid, solid or gaseous Hazardous Material, or any combination thereof, into the atmosphere or on, into or under the Premises, any building or other improvements of which the Premises are a part, or the ground or any body of water which Hazardous Material, if discharged or emitted into the atmosphere, the ground or any body of water would be in violation of law or regulation and does or may (a) pollute or contaminate the same, or (b) adversely affect the (i) health or safety of persons, whether on the Premises or anywhere else, (ii) condition, use or enjoyment of the Premises or any real or personal property, whether on the Premises or anywhere else, or (iii) the Premises or any of the improvements thereto including buildings, foundations, pipes, utility lines, landscaping or parking areas; 8.1.3 Produce, or permit to be produced, any intense glare, light or heat in violation of law or regulations; 8.1.4 Create, or permit to be created, any sound pressure level which will create a nuisance or violate any governmental law, rule, regulation or requirement; 8.1.5 Create, or permit to be created, any vibration that is discernible outside the Premises; or 8.1.6 Transmit, receive or permit to be transmitted or received from or to the Premises, any electromagnetic, microwave or other radiation which is or may be harmful or hazardous to any person or property in, or about the Premises, or anywhere else.

Emissions. Tenant shall not: 8.1.1 1) Knowingly permit any vehicle on the Premises or in the Commons Areas to emit Hazardous Materials (defined below) exhaust which is in violation of any governmental law, rule, regulation or requirement; 8.1.2 2) Discharge, emit or permit to be discharged or emitted, any liquid, solid or gaseous Hazardous Materialmatter, or any combination thereof, into the atmosphere or on, into or under the Premises, any building or other improvements of which the Premises are a part, or the ground or any body of water which Hazardous Materialmatter, if discharged or emitted into the atmosphere, the ground as reasonably determined by Landlord or any body of water would governmental entity to be in violation of law or regulation regulation, and does or may (a) pollute or contaminate the same, or (b) is, or may become, radioactive or does, or may, adversely affect (a) the (i) health or safety of persons, wherever located, whether on the Premises or anywhere else, (iib) the condition, use or enjoyment of the Premises or any other real or personal property, whether on the Premises or anywhere else, or (iiic) the Premises or any of the improvements thereto including buildings, foundations, pipes, utility lines, landscaping or parking areas; 8.1.3 3) Produce, or permit to be produced, any intense glare, light or heat in violation of law or regulations; 8.1.4 4) Create, or permit to be created, any sound pressure level which will interfere with the quiet enjoyment of any real property outside the Premises, or which will create a nuisance or violate any governmental law, rule, regulation or requirement; 8.1.5 5) Create, or permit to be created, any vibration that is discernible outside the Premises; or 8.1.6 6) Transmit, receive or permit to be transmitted or received from or to the Premises, any electromagnetic, microwave or other radiation which is or may be harmful or hazardous to any person or property in, or about the Premises, or anywhere else.

Tenant shall not: 8.1.1 1) Knowingly permit any vehicle on the Premises or in the Commons Areas to emit Hazardous Materials (defined below) exhaust which is in violation of any governmental law, rule, regulation or requirement; 8.1.2 2) Discharge, emit or permit to be discharged or emitted, any liquid, solid or gaseous Hazardous Materialmatter, or any combination thereof, into the atmosphere or on, into or under the Premises, any building or other improvements of which the Premises are a part, or the ground or any body of water which Hazardous Material, if discharged or emitted into the atmosphere, the ground matter. as reasonably determined by Landlord or any body of water would governmental entity to be in violation of law or regulation regulation, and does or may (a) pollute or contaminate the same, or (b) is, or may become, radioactive or does, or may, adversely affect (a) the (i) health or safety of persons, wherever located, whether on the Premises or anywhere else, (iib) the condition, use or enjoyment of the Premises or any other real or personal property, whether on the Premises or anywhere else, or (iiic) the Premises or any of the improvements thereto including buildings, foundations, pipes, utility lines, landscaping or parking areas; 8.1.3 3) Produce, or permit to be produced, any intense glare, light or heat in violation of law or regulations; 8.1.4 4) Create, or permit to be created, any sound pressure level which will interfere with the quiet enjoyment of any real property outside the Premises, or which will create a nuisance or violate any governmental law, rule, regulation or requirement; 8.1.5 5) Create, or permit to be created, any vibration that is discernible outside the Premises; or 8.1.6 6) Transmit, receive or permit to be transmitted or received from or to the Premises, . any electromagnetic, microwave or other radiation which is or may be harmful or hazardous to any person or property in, or about the Premises, or anywhere else.

Emissions. Tenant shall notFrom and after the Effective Date and throughout the Term of this Lease: 8.1.1 Knowingly permit (i) Permit any vehicle on the Premises or in the Commons Areas Project to emit Hazardous Materials (defined below) exhaust which is in violation of any governmental law, rule, regulation or requirement; 8.1.2 (ii) Discharge, emit or permit to be discharged or emitted, any liquid, solid or gaseous Hazardous Materialmatter, or any combination thereof, into the atmosphere or on, into or under the Premises, any building or other improvements of which the Premises are a part, or the ground or any body of water which Hazardous Material, if discharged or emitted into the atmosphere, the ground or any body of water would be in violation of law water, which matter, as reasonably determined by Landlord or regulation and any governmental entity with jurisdiction, does or may (a) pollute or contaminate the same, or (b) is or may become radioactive, or may adversely affect (1) the (i) health or safety of persons, whether on the Premises Premises, the Project, or anywhere elseelsewhere, (ii2) the condition, use or enjoyment of the Premises or the Project or any other real or personal property, whether property located on the Premises Project or anywhere elseelsewhere, or (iii3) the Premises Project or any of the improvements thereto constructed thereon, including buildings, foundations, pipes, utility lines, landscaping or parking areas; 8.1.3 (iii) Produce, or permit to be produced, any intense glare, light or heat except within an enclosed or screened area, and then only in violation of law such manner that the glare, light or regulationsheat shall not be discernible from outside the Premises; 8.1.4 (iv) Create, or permit to be created, any sound pressure level which will interfere with the quiet enjoyment of any real property outside the Project, or which will create a nuisance or violate any governmental law, rule, regulation or requirement; 8.1.5 Create, (v) Create or permit to be created, created any ground vibration that is discernible outside the Premises; or 8.1.6 (vi) Transmit, receive or permit to be transmitted or received from or to the Premisesreceived, any electromagnetic, microwave or other radiation which is or may be harmful or hazardous to any person or property in, on or about the Premises, Project or anywhere elseelsewhere.

Emissions. Tenant Tenant, its agents, employees, licensees and invitees --------- shall not: 8.1.1 Knowingly permit a) Permit any vehicle on the Premises or in the Commons Areas to emit Hazardous Materials (defined below) exhaust which is in violation of any governmental law, rule, regulation or requirement; 8.1.2 Discharge, b) Discharge or emit or permit to be discharged or emitted, any liquid, solid or gaseous Hazardous Materialmatter, or any combination thereof, into the atmosphere or on, into or under the Premises, any building or other improvements of which the Premises are a part, or the ground or any body of water which Hazardous Material, if discharged or emitted into the atmosphere, the ground or any body of water would be in violation of law which matter, as reasonable determined by Lessor or regulation and does any governmental entity, does, or may (a) may, pollute or contaminate the same, or (b) is, or may become, radioactive or does, or may, adversely affect the the: (ia) health or safety of or persons, wherever located, whether on the Premises or anywhere else, ; (iib) condition, use or enjoyment of the Premises or any other real or personal property, whether on the Premises or anywhere else, ; or (iiic) the Premises or any of the improvements thereto or thereon including buildings, foundations, pipes, utility lines, landscaping or parking areas; 8.1.3 c) Produce, or permit to be produced, any intense glare, light or heat except within an enclosed or screened area and then only in violation of law such manner that the glare, light or regulationshear shall not be discernible from outside the Premises; 8.1.4 d) Create, or permit to be created, any sound pressure level which will interfere with quiet enjoyment of any real property outside the Premises, or which will create a nuisance or violate any governmental law, rule, regulation or requirement;. 8.1.5 e) Create, or permit to be created, any ground vibration that is discernible outside the Premises; or. 8.1.6 f) Transmit, receive or permit to be transmitted or received from or to the Premisesreceived, any electromagnetic, microwave or other radiation which is or may be harmful or hazardous to any person or property in, or about the Premises, or anywhere else.

Emissions. Tenant shall not: 8.1.1 Knowingly permit 1) Permit any vehicle of Tenant's vehicles on the Premises or in the Commons Areas premises to emit Hazardous Materials (defined below) exhaust which is in violation of creates any governmental law, rule, regulation hazard to human health or requirementthe environment; 8.1.2 2) Discharge, emit or permit to be discharged or emitted, any liquid, solid or gaseous Hazardous Materialmatter, or any combination thereof, into the atmosphere or on, into or under the Premises, any building or other improvements of which the Premises are a part, or the ground or any body of water which Hazardous Material, if discharged or emitted into the atmosphere, the ground or any body of water would be in violation of law which matter, as reasonably determined by Lessor or regulation and does any governmental entity, does, or may (a) may, pollute or contaminate the same, or (b) is, or may become, radioactive or does, or may, adversely affect the (ia) health or safety of persons, wherever located, whether on the Premises or anywhere else, (iib) condition, use or enjoyment of the Premises or any other real or personal property, whether on the Premises or anywhere else, or (iiic) the Premises or any of the improvements thereto or thereon including buildings, foundations, pipes, utility lines, landscaping or parking areas; 8.1.3 3) Produce, or permit to be produced, any intense glare, light or heat except within an enclosed or screened area and then only in violation of law such manner that the glare, light or regulationsheat shall not be discernible from outside the Premises; 8.1.4 4) Create, or permit to be created, any sound pressure level which will interfere with the quiet enjoyment of any real property outside the Premises, or which will create a nuisance or violate any governmental law, rule, regulation or requirement; 8.1.5 5) Create, or permit to be created, any ground vibration that is discernible outside the Premises; orand 8.1.6 6) Transmit, receive or permit to be transmitted or received from or to the Premisesreceived, any electromagnetic, microwave or other radiation which is or may be harmful or hazardous to any person or property in, or about the Premises, or anywhere else. Notwithstanding the above, Tenant shall be entitled to manufacture medical testing equipment not involving any radioactive materials, but using such materials as are commonly used in light manufacturing, so long as Tenant strictly complies with all applicable governmental laws and regulations regulating such materials.

Emissions. Tenant Lessee shall not: 8.1.1 Knowingly permit (a) Permit any vehicle on the Premises or in the Commons Areas premises to emit Hazardous Materials (defined below) exhaust which is in violation of any governmental law, rule, regulation or requirementrequirements; 8.1.2 (b) Discharge, emit or permit to be discharged or emitted, any liquid, solid or gaseous Hazardous Materialmatter, or any combination thereof, into the atmosphere or on, into or under the Premises, any building or other improvements of which the Premises are a part, or the ground or any body of water which Hazardous Material, if discharged or emitted into the atmosphere, the ground or any body of water would be in violation of law water, which matter, as reasonably determined by Lessor or regulation and does any governmental entity, does, or may (a) may, pollute or contaminate the same, or (b) is, or may become, radioactive or does, or may, adversely affect the (i1) health or safety of persons, wherever located, whether on the Premises or anywhere else, (ii2) condition, use or enjoyment of the Premises or any other real or personal property, whether on the Premises or anywhere else, or (iii3) the Premises or any of the improvements thereto or thereon including buildings, foundations, pipes, utility lines, lines landscaping or parking areas; 8.1.3 (c) Produce, or permit to be produced, any intense glare, light or heat except within an enclosed or screened area and then only in violation of law such manner that the glare, light or regulationsheat shall not be discernible from outside the Premises; 8.1.4 (d) Create, or permit to be created, any sound pressure level which will interfere with the quiet enjoyment of any real property outside the Premises, or which will create a nuisance or violate any governmental government law, rule, regulation or requirement; 8.1.5 Create(e) create, or permit to be created, any ground vibration that is discernible outside the Premises; or; 8.1.6 (f) Transmit, receive receive, or permit to be transmitted or received from or to the Premisesreceived, any electromagnetic, microwave or other radiation which is or may be harmful or hazardous to any person or property in, on or about the Premises, or anywhere else.

Emissions. Tenant shall not: 8.1.1 1) Knowingly permit any vehicle on the Premises or in the Commons Areas to emit Hazardous Materials (defined below) exhaust which is in violation of any governmental law, rule, regulation or requirement; 8.1.2 2) Discharge, emit or permit to be discharged or emitted, any liquid, solid or gaseous Hazardous Materialmatter, or any combination thereof, into the atmosphere or on, into or under the Premises, any building or other improvements of which the Premises are a part, or the ground or any body of water which Hazardous Materialmatter, if discharged or emitted into the atmosphere, the ground as reasonably determined by Landlord or any body of water would governmental entity to be in violation of law or regulation regulation, and does or may (a) pollute or contaminate the same, or (b) is, or may become, radioactive or does, or may, adversely affect (a) the (i) health or safety of persons, wherever located, whether on the Premises or anywhere else, (iib) the condition, use or enjoyment of the Premises or any other real or personal property, whether on the Premises or anywhere else, or (iiic) the Premises or any 10 of the improvements thereto including buildings, foundations, pipes, utility lines, landscaping or parking areas; 8.1.3 3) Produce, or permit to be produced, any intense glare, light or heat in violation of law or regulations; 8.1.4 4) Create, or permit to be created, any sound pressure level which will interfere with the quiet enjoyment of any real property outside the Premises, or which will create a nuisance or violate any governmental law, rule, regulation or requirement; 8.1.5 5) Create, or permit to be created, any vibration that is discernible outside the Premises; or 8.1.6 6) Transmit, receive or permit to be transmitted or received from or to the Premises, any electromagnetic, microwave or other radiation which is or may be harmful or hazardous to any person or property in, or about the Premises, or anywhere else. Notwithstanding the provisions of this P.8,Tenant may store and use Hazardous Materials in the ordinary course of the Permitted Use, so long as such Hazardous Materials are stored and used only in such quantities as are reasonably incidental to the Permitted Use and in strict compliance with this Lease and all applicable governmental regulations.
