Employee Benefits and Pension Plan. 18.01 Effective January 1, 2009 the Employees will com- mence participation in the Corporate Flexible Benefit Program. The Company agrees to provide each seniority Em- ployee with Flex Credits on an annual basis, to pur- chase benefit coverage from the Company’s flexible benefit program “Choices”. All of the benefit plans described in the Company booklets shall be as more particularly described and set forth in the respective benefit plans and policies which plans and policies shall be made available for inspection by the Union. During the term of this agreement, the Company will maintain the same selection and level of benefits and the cost-sharing ratio as is currently in place. 18.02 Any dispute over payment of benefits under any benefit plan or policy under this Collective Agree- ment shall be adjusted between the Employee and the insurer concerned and the parties agree that such disputes are inarbitrable under this agreement and shall not be subject to the Arbitration Procedure of this agreement. The Company will use its best efforts to adjust and settle any such disputes. 18.03 Employees hired after April 1, 2002 will participate in the Reliance Comfort Limited Partnership Defined Contribution Registered Pension Plan for HVAC Employees. For purposes of determining vesting, all continuous service with Reliance and any predeces- sor company will be used. Existing Employees wish- ing to join the Pension Plan must elect to do so prior to the expiry of this Collective Agreement. New Full time and Continuous Part-Time Employees will become participants in the Pension Plan upon successful completion of the probation period.

18.03 Employees hired after April 1, 2002 (a) The Company will participate in the Reliance Comfort Limited Partnership make available a Defined Contribution Registered Pension Plan (DCPP) for HVAC Employees. For purposes all members of determining vesting, all continuous service with Reliance and any predeces- sor company the bargaining unit.
(b) Employees will be used. Existing Employees wish- ing to join become participants in the De- fined Contribution Pension Plan must elect to do so prior and shall con- tribute a minimum of one percent (1%) of nor- mal earnings to the expiry DCPP.
(c) The employer will match the employee’s con- tributions to a maximum three percent (3%) of this Collective Agreementnormal earnings per calendar year. New Full time and Continuous Part-Time Employees will become participants in the Pension Plan upon successful completion of the probation period.
