Unpaid Leaves of Absence. 24.01 An employee who has completed one (1) year of continuous service with the Employer may be granted a leave of absence without pay or benefits because of injury, illness, education purposes, employment by the Union, or other personal reasons, including maternity leave. The decision to grant the leave or the length of the leave period will be at the discretion of the Employer with due consideration given to the reasons and evidence presented by the employee to the Employer. Such requests shall not be unreasonably denied.
24.02 All leaves of absence (and any extensions thereof) must be applied for and granted in writing on forms provided by the Employer (with a copy to the employee). Except in cases of emergency, the leave request shall be filed with the employee's Department Head not later than two (2) weeks prior to the date on which the leave is to start. Along with the request for the leave, he shall supply any and all available documentation in support of said leave. This documentation shall consist of medical proof of disability in cases where the leave is for medical purposes and the specific reason for the leave when the leave is for other purposes. An employee will be notified in writing within five (5) working days from the date the application was made of the approval or disapproval of the leave of absence request for ten (10) working days or less. For a leave request in excess of ten (10) working days, the employee will be notified within two (2) weeks from the date the application was made of the approval or disapproval of the leave. An employee who is granted such a leave shall not accrue any benefits during his absence, including seniority.
24.03 Leaves of absence will not be granted for the employee to seek employment with another employer, nor shall any employee work for another employer during the time period he is on leave. Any employee who works for another employer while on leave shall have his leave canceled immediately and be subject to disciplinary action.
24.04 When an employee returns to work after a leave of absence, he will be assigned to the position which he formerly occupied or to a similar position if his former position no longer exists at the applicable rate of pay, provided the employee is able to perform the work.
24.05 An employee may, upon request, return to work prior to the expiration of any leave of absence, provided that such early return is agreed to by the Employer.

Unpaid Leaves of Absence. A. An unpaid leave of absence of up to one (1) year may be granted to any contract teacher for the purpose of participating in exchange teaching programs in other states, territories or countries; foreign, embassy and/or military teaching programs; the Peace Corps, Teacher's Corps, or Job Corps as a full-time participant in such program; or a cultural, travel or work program related to his/her professional responsibilities; or for personal health reasons, provided such employee states his/her intention to return to the school system. Requests for such leave shall be submitted in writing by April 1 for the Board's consideration.
B. An unpaid leave of absence of up to one (1) year may be granted to a contract teacher upon application for the purpose of engaging in study related to his/her professional responsibilities. Requests for such leave shall be submitted in writing for the Board's consideration.
C. An unpaid leave of absence of up to one (1) year may be granted to a contract teacher for the purpose of serving as an elected officer of the state association.
D. An unpaid leave of absence not to exceed one (1) year may be granted to any contract teacher for the purpose of campaigning for his/her own candidacy or serving in an elected public office.
E. All benefits to which a contract teacher was entitled at the time his/her unpaid leave of absence commenced, and which are currently in effect for contract teachers, as well as unused accumulated sick leave and accrued years toward developmental leave eligibility, shall be restored to him/her upon his/her return.
F. Upon the contract teacher’s return to the District, the District shall endeavor to place the certificated employee in the same or similar position as was vacated and shall advance the employee on the salary schedule.
G. All extensions or renewals of unpaid leaves shall be applied for and granted or denied in writing. Failure to return to the District from an unpaid leave at its expiration will be considered a resignation, unless such leave has been extended by the Board.
H. Unpaid maternity leave shall be granted upon request. A request for maternity leave and the length of time requested must be submitted to the superintendent fifteen (15) days in advance of the date said leave is to commence. Unpaid Leaves of Absence.
A. A maximum leave of absence of one (1) year without pay shall be granted an employee desiring to further his/her education, providing said education is in a field of study related to the employee's current assignment. When the employee provides evidence of completion of the educational experience for which the leave was given, the regular step increment for this year shall be allowed. An increment will not be given to the employee who does not complete a full year of additional educational experience as prescribed in the request for said leave which has been approved by the Board.
B. Military leave of absence without pay shall be granted according to the provisions of Michigan and federal law. An employee shall be entitled to the step increments and seniority for military service time as required by law. Employees required to fulfill annual training duty with reserve units, which conflict with the school calendar, shall be given leave without pay.
C. Employees who are elected offices of the State or National Association shall be given a leave of absence without pay for purposes of performing duties of the Association. Employees given such leave of absence shall not be given credit for annual step increment. Such leave shall not exceed the term of office held by the employee.
D. With at least thirty (30) days written notification to the Board (shorter notice will be accepted where the need for leave is not foreseeable) stating the nature of the child care or emergency situation, any employee who has at least one (1) year of employment will be given a maximum unpaid leave of absence of up to one (1) year for personal disability, for child care or immediate family emergencies.
E. An employee who has been employed five (5) years in the Oakridge Public Schools can request a one (1) year unpaid leave of absence if the certain criteria and procedures outlined below have been met. Each request for the unpaid leave of absence will be considered on its individual merits. The applications shall be submitted in accordance with the provisions of this Article. The particular circumstances surrounding each leave will be reviewed by the Board with the understanding that its decision will in no way establish a precedent. Unpaid Leaves of Absence. 1. Bargaining unit members may, under conditions specified herein, under state law and/or Board Policy, be granted leaves of absence without pay. It is understood that no member shall have a right to such unpaid leave for sporadic or short-term absences, whether or not based upon illness (unless qualified under appropriate FMLA leave). For example, unpaid leave may not be granted for non-FMLA qualifying absence to extend the employment of a member where such member has exhausted all accumulated and/or advanced sick leave, unless the request is for long term unpaid leave and based upon legitimate medical reasons.
2. An employee may submit a written request for an unpaid leave of absence for reasons of illness or other disability. The Board of Education shall grant such leave of absence for a period of time not to exceed two (2) consecutive school years. Such illness or disability must be confirmed in writing by the attending physician. Subsequent requests for such leave may be renewed by the Board.
3. An employee having five (5) years of service with the Board may submit a written request for a leave of absence for reasons other than illness or disability. Each request shall be judged on its own individual merit. In such cases, the Board may approve a leave for a period not to exceed six (6) months. Subsequent requests may be renewed by the Board. No more than two (2) such leaves per year will be considered.
4. Eligible employees who are on an approved Board of Education leave of absence shall have the opportunity of continuing to receive Cleveland Heights-University Heights group insurance coverage. Such employees must reimburse the Board for the premium costs. Failure of the individual to forward payments to the Board at the stipulated times will terminate this option.
5. Employees, on return from leave, are assured of employment and will be returned to their former classification. If a leave of absence is required for six or more months, the position will be posted and filled. Upon returning to work, if there is no vacant position in the returning employee’s job classification, the returning employee may bump as set forth under Art. 13 § C. The employee bumped has the same bumping rights as outlined in this section. Time spent on unpaid leave will not be credited towards seniority or as experience on the salary schedule.
Unpaid Leaves of Absence. Employees may apply for unpaid leaves of absence for any period of consecutive days. Such leaves of absence must be approved by the employee’s immediate supervisor and the Superintendent of Schools, and are wholly discretionary on the part of the immediate supervisor and the Superintendent of Schools.

Unpaid Leaves of Absence. 3.1. Short-Term Leaves of Absence. A leave of absence without pay, not covered by any other provision of this Agreement, for a period not exceeding 30 consecutive days may be granted to a comprehensive leave eligible employee by the employee’s director.
Unpaid Leaves of Absence. (1) Illness/Disability/General Leave
(a) An employee who, because of illness or accident which is non-compensable under the Worker's Compensation Law, is physically unable to report to work and has exhausted all allowable means of compensation shall be granted a leave of absence for up to one (1) year, which may be extended upon approval by the Board, provided the employee promptly notifies the Board of the necessity therefore, and provided further, that the employee supplies the Board with a statement from a medical or osteopathic doctor of the necessity for such absence when the Board requests the same. An employee upon returning from a medical leave of absence, may be required to submit to a physical examination, at the Board's expense before returning to work.
(b) Leaves of absence shall be granted for a reasonable period of time not to exceed one (1) year for for physical or mental illness, or prolonged serious illness in the immediate family, which shall include husband, wife, children or parents.
(c) Leaves of absence may be granted for a specified period of time for training related to an employee's regular duties in an approved educational institution.
(d) Whenever an employee shall become pregnant, and is required to interrupt her employment upon the advice of her physician, she shall immediately be granted a leave of absence. Upon her return to work, she will be required to furnish a signed medical statement to the Board from her physician indicating that she is physically able to return to work. It is expressly agreed by the parties that the Board is not liable for the health and welfare of the unborn child during the time the employee continues to work during her pregnancy.
(e) The reinstatement rights of any employee who enters the military service of the United States by reason of an act or law enacted by the Congress of the United States, or who may voluntarily enlist during the effective period of such law, shall be determined in accordance with the provisions of the law granting such rights.
(f) Leaves of absence will be granted to employees who are active in the National Guard or a branch of the Armed Forces Reserves for the purpose of fulfilling their annual field training obligations, provided such employee(s) make written request for such leave of absence immediately upon receiving their orders to report for such duty.

Unpaid Leaves of Absence. Section 1: A teacher may be granted a year’s leave of absence without pay for education, travel, child rearing, or personal reasons. A teacher returning from such leave shall have all accrued benefits restored and will have performance in their last year worked applied to the returning year’s compensation model. By May 1 of the year of the leave, teachers must inform the principal of their intention to return or resign from their position for the following school year.
Section 2: Any teacher may be granted a leave of absence without pay for periods of less than one (1) school year when justifiable reasons exist. In case of adoption, a teacher shall be granted an adoptive leave commencing when the child is physically turned over to the teacher-parent. In granting such leaves, the Board may attach conditions to include, but not limited to, earliest and latest date of return, and teaching position to which the teacher can expect to be assigned. Leave may be extended one (1) succeeding school year if the teacher submits a written request to the building administrator or immediate supervisor prior to May 1 of the school year and upon approval by the Board.
Section 3: Any leave of absence will be granted with the understanding that it is a leave of absence from the School Corporation and not from a particular position. Upon a teacher’s return from leave, every effort will be made to restore that teacher to the same or comparable position held before the leave. When this is not possible in the Board’s judgment, the returning teacher shall be offered a position for which the teacher is qualified.
Section 4: A teacher who is granted an unpaid leave of absence during the regular school year shall have sick leave credits for that year reduced by one (1) day for each month, or portion thereof, of absence.
Section 5: The procedure for applying for an unpaid leave of absence under this Article shall be as follows:
a. The request for leave must be submitted in writing to the building administrator or immediate supervisor prior to July 1 of the year requested for a leave under Section 1 and at least thirty (30) days prior to the starting date of the leave, for leave under Section

Upon return from such leave, a teacher shall be placed on the same position on the salary schedule as he/she would have been had he/she taught in the district during such period. A teacher on military leave due to being drafted shall be given the benefit of any increments up to two (2) years which would have been credited to him had he/she remained in active service to the school system. The teacher shall retain the sick leave allowance which he accumulated prior to his military leave.
B. Leave of absence without pay may be granted upon application for no more than one (1) year for the following purposes:
1. Study related to the teacher's major or minor fields.
2. Study to meet eligibility requirements for certification other than that held by the teacher.
X. A tenured teacher may apply to the Board for a leave of absence for any reason.
1. The Board, however, is under no obligation to grant the leave request and any decision does not set a precedent and is non-grievable.
2. A teacher on leave does not lose accumulated seniority but does not receive seniority credit for the leave period.
3. That upon return to work within twelve (12) months, the employee shall be reinstated to their former position, if it still exists, or if it does not exist, a comparable position.
4. The teacher must notify the Board in writing of their intent to return by March 1 of the year said leave takes place.
5. Failure to return as set forth herein to follow the above requirements and responsibilities shall mean that employment shall be terminated.
D. Teachers on leaves of absence shall return to duty only at the beginning of a semester. Teachers must write the Personnel Department not later than November 1 in the Fall semester or March 1 in the Spring semester prior to the expiration date of said leave notifying the district of their plans for the next semester.
