Employee Failure to Comply. The parties agree that a failure of an obligated employee in a bargaining unit to pay a fair share fee shall be grounds for the Union to file an action in Small Claims Court subject to the following procedures. 1. The Union shall notify the employee (a copy to Human Resources Department and the appointing authority) of non-compliance by certified mail, return receipt requested. Said notice shall detail the non-compliance by explaining that the employee is delinquent in not tendering a fair share service fee, specifying the amount of the delinquency, and warning the employee that unless such fees are tendered within thirty (30) calendar days, the Union will file an action in Small Claims Court. 2. If the employee fails to comply, the Union may file an action in Small Claims Court.

Said notice shall detail the non-compliance by explaining that the employee is delinquent in not tendering a fair share service fee, specifying the amount of the delinquency, and warning the employee that unless such fees are tendered within thirty (30) calendar days, the Union will file an action in Small Claims Court.
2. If the employee fails to comply, the Union may file an action in Small Claims Court.
