Employer not Liable for Damage. The Employer shall not be liable for loss or damage to any of the Construction Plant, Temporary Works, Equipment, materials or goods nor for any loss, expense, costs, damages, liability or claim arisingfrom the presence or use of the Construction Plant, Temporary Works, Equipment, materials or goods due to Excepted Risks or except and to the extent that the same is caused by any act or neglect of the Employer or of any person for whom the Employer is responsible.
