Common use of Enabling Provision Clause in Contracts

Enabling Provision. 33.01 Where a particular Article or Articles of this Collective Agreement is or are found to work a hardship in a specific Local Union jurisdictional territory the terms and conditions in this Agreement for that Local Union area may be changed or amended by Local Employer Associations and Local Unions subject to the condition that such change or amendment shall not be effective unless and until it has the written agreement of both Architectural Glass and Metal Contractors Association and the Ontario Provincial Council, International Union of Painters and Allied Trades. Any change or amendment shall only be effective in the geographic area involved.
