Common use of Enabling Provision Clause in Contracts

Enabling Provision. The signatory Producer may request certain modifications to the terms and provisions contained in this Agreement which are production specific. This request must be submitted in writing to the Union office, in care of the Business Manager. The Union agrees to consider requests for modifications and make reasonable efforts to respond to the Producer within three (3) business days of receipt of the request. Any such agreement shall be by Letter of Understanding with a copy to the CMPA-BC and may be for one (1) production, for a type of production, for a specific area, or for a specific period of time. Any need for interpretation which might arise from the application of the terms of the modifications, shall be referred directly to the Consultation Committee for resolution.
