Common use of Encumbrancer’s consent Clause in Contracts

Encumbrancer’s consent. The Developer covenants that upon execution of this Agreement it shall cause every person having an encumbrance or charge affecting the Lands to postpone such interests in favour of the Township’s interests pursuant to this Agreement and to provide duplicate registered copies of such postponement agreements to the Township’s solicitor.
