Common use of Energy Before Commissioning Clause in Contracts

Energy Before Commissioning. 4.6.1 Upon the Seller's request and successful negotiations on the grid extension, the Purchaser may provide energy for construction, testing, Commissioning, Start- Ups and Emergencies, subject to availability and the Purchaser's ability to deliver such energy to the Plant and the Seller shall pay the Purchaser for such energy and grid extension works in accordance with the Purchaser's then prevailing tariff rate for industrial facilities and capital costs incurred respectively. 4.6.2 The Purchaser is hereby authorized to set-off the charges for such energy delivered by the Purchaser to the Seller pursuant to this Clause4.6 against any Energy Payments due and owing to the Seller. 4.6.3 The Purchaser shall not be liable for any Capacity Payments and Energy Charges prior to the Commercial Operations Date.
