ENERGY FROM WASTE WITH CHP. (A) The Facility: (i) (subject to paragraph (B)) generates electricity solely from Waste, Biomass or a combination thereof; and (ii) only uses Biomass, Waste or a combination thereof in respect of which the Energy Content constituting Fossil Fuel (excluding any Fossil Fuel used to undertake Permitted Ancillary Activities) as a percentage of all fuels used by the Facility, is more than ten per cent. (10%). (B) The Permitted Ancillary Activity Exception applies. (C) No Fossil Fuel is used at the Facility for the express purpose of it being used as a fuel (other than to undertake Permitted Ancillary Activities), unless it forms part of Waste from which the fuel is produced.
