Common use of Enforceability of Covenant Clause in Contracts

Enforceability of Covenant. The Executive and the Company agree that the Executive's obligations under the nondisclosure covenant contained herein is separate and distinct from other provisions of this Agreement, and the failure or alleged failure of the Company to perform its obligations under any provisions of this Agreement (other than its payment obligations hereunder) shall not constitute a defense to the enforceability of the nondisclosure covenant.
