Common use of ENROLLMENT EXEMPTIONS Clause in Contracts

ENROLLMENT EXEMPTIONS. The contractor, its subcontractors, providers or agents shall not coerce individuals to disenroll because of their health care needs which may meet an exemption reason, especially when the enrollees want to remain enrolled. Exemptions do not apply to NJ FamilyCare Plan B, Plan C, or Plan D individuals or to individuals who have been enrolled in any contractor for greater than one hundred and eighty (180) days. All exemption requests are reviewed by DMAHS on a case by case basis. Individuals may be exempted by DMAHS from enrollment in a contractor for the following reasons:
