Entering and Withdrawing by Individual Departments. A CalHR holds the unilateral right to permit a Department, not already a participant in this Agreement, to enter the Agreement. If a new Department seeks to participate under the Agreement, CalHR and State Fund will perform a risk assessment to assure that any Department entering this Agreement understands and is able to meet its fiscal responsibility under this Agreement. An appropriate Service Fee and an initial Working Capital Account will be negotiated between State Fund and CalHR which will apply to the new Department. B CalHR will, upon any Department's breach of any of its financial obligations under this Agreement, provide that Department sixty (60) calendar days notice of automatic withdrawal from the Agreement, specifying the reason for the automatic withdrawal. The Department shall have thirty (30) calendar days from the notice to cure the breach or demonstrate a substantial effort to cure the breach. If the Department does not correct the breach within the second thirty (30) day period, the Department will be automatically withdrawn from the Agreement. The Department will have the option to apply for a policy of insurance with State Fund. C A Department may make a request to CalHR to withdraw from the Agreement for the purpose of self-administration of its workers’ compensation claims. Such a request must be submitted in writing to CalHR and State Fund one (1) year in advance of the proposed implementation date, and include a detailed description of the Department’s implementation plan.
